No, this isn’t an April fools joke, Nintendo is suing Bowser, not that one though.

As reported by Polygon, Nintendo of America has filed a lawsuit against Gary Bowser, a 51-year old Canadian who is alleged to be a member of the Nintendo Switch hacker group known as Team Xecuter.

Gary Bowser is currently in custody in the US after being arrested in the Dominican Republic in September. The following month the US government issued multiple federal charges against Bowser as well as 48-year old French national called Max Louarn, and Yuanning Chen, a 35-year old from China. Louarn was arrested in Canada while Chen has yet to be arrested on these charges.

Nintendo is alleging that Team Xecuter infringed Nintendo’s copyrights by creating and selling hacks. Team Xecuter has been selling modchips for years dating back to the original Xbox.

Some of their popular devices include the Gateway 3DS a flash rom cart that allows gamers to use pirated roms on their 3DS consoles.

It is being reported that Nintendo is seeking damages to the tune of $2500 for each device sold, as well as $150,000 for each copyright violation as well as the closure of Team Xecuter, that is a pretty hefty chunk of change that the team, and specifically Bowser, may need to pay.

It is also quite amusing that the President of Nintendo of America, Doug Bowser, is suing Gary Bowser, so the court case is Bowser vs Bowser.
